RewritePal Terms of Service

1. Agreement and contracting party

These Terms of Service ("Terms") govern your access to and use of the RewritePal website, web application, Chrome extension, AI features, accounts, paid features, and related services (collectively, the "Service").

"RewritePal," "we," "us," and "our" refer to the operator of the Service. RewritePal is operated from Brazil.

By creating an account, purchasing access, clicking to accept these Terms, or otherwise using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you use the Service for an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.

Mandatory consumer, privacy, and other rights that cannot legally be waived remain effective despite anything in these Terms.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into these Terms. If applicable law allows a person under 18 to use the Service with a parent or legal guardian, that adult must review and agree to these Terms and is responsible for the minor's use.

Account information must be accurate and current. You are responsible for protecting your credentials and for activity under your account. You must promptly notify us of suspected unauthorized access. You may not share, sell, transfer, lease, or make an account available to another person. We may reject, suspend, or require changes to an account that is fraudulent, misleading, insecure, or violates these Terms.

3. The Service

RewritePal provides automated writing, rewriting, explanation, grammar, and related tools. Some features may be experimental, limited to particular languages, plans, browsers, devices, regions, or usage levels. Feature descriptions and limits displayed in the Service or at checkout form part of these Terms.

We may add, modify, replace, suspend, or remove features, models, integrations, limits, or interfaces. We do not guarantee that a particular AI model, provider, integration, feature, or free allowance will remain available. If a change materially affects paid access, any remedy will be determined under these Terms, the applicable offer, and non-waivable law.

Subject to these Terms, RewritePal grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service through its intended interfaces. No other rights are granted.

4. Acceptable use

You may use the Service only for lawful purposes. You must not:

  • Break the law, infringe rights, commit fraud, deceive people, or facilitate illegal activity.
  • Submit content you do not have the right to process or content that unlawfully exposes another person's private, confidential, or personal information.
  • Target a real person or protected group with unlawful harassment, threats, exploitation, discrimination, or incitement to violence.
  • Sexualize minors, create or intensify non-consensual sexual acts, sexually exploit a real person, create child sexual abuse material, or facilitate real-world harm. Lawful fiction may include consensual adult sexual material, horror, and fictional violence, subject to these hard limits.
  • Generate or distribute malware, phishing, spam, credential theft, unauthorized surveillance, or instructions intended to compromise systems or safety.
  • Reverse engineer, scrape, copy, frame, resell, sublicense, or commercially exploit the Service except as applicable law expressly permits despite this restriction.
  • Bypass access controls, quotas, rate limits, payment controls, content safeguards, or security measures.
  • Use automation, bots, bulk access, shared accounts, or abnormal request patterns unless we authorize them in writing.
  • Interfere with the Service, burden its infrastructure, probe vulnerabilities without written permission, or help another person do anything prohibited by these Terms.

We may investigate suspected violations using account, usage, security, and technical records. We do not promise to monitor submitted writing, and our ability to detect or prevent misuse does not create a duty to do so.

5. Your content and AI output

You retain any rights you hold in text, instructions, and other content you submit ("Input"). You represent that you have the rights and permissions needed for RewritePal and its service providers to process your Input as described in these Terms and the Privacy Policy.

You grant RewritePal a worldwide, non-exclusive, royalty-free license to host, transmit, reproduce, modify, and otherwise process Input and generated output only as reasonably needed to operate, secure, troubleshoot, and provide the Service, comply with law, and enforce these Terms. This license ends when the relevant processing and permitted retention end, except for information lawfully retained under the Privacy Policy.

As between you and RewritePal, and to the extent rights exist under applicable law, you may use generated output for lawful personal or commercial purposes. RewritePal does not claim ownership of your Input or generated output. AI output may not be unique, may be similar or identical to output received by others, and may not qualify for intellectual property protection. We do not transfer rights belonging to another person.

You are responsible for reviewing Input and output, obtaining necessary permissions, preserving confidentiality, and deciding whether output is appropriate for your purpose. Do not submit highly sensitive, regulated, confidential, or secret information unless you accept the processing described in the Privacy Policy and are legally authorized to do so.

6. AI limitations and no professional advice

Artificial intelligence can produce inaccurate, incomplete, offensive, outdated, or misleading output. RewritePal does not verify the truth, originality, legality, authorship, or suitability of output. Detector results are estimates and do not prove whether a person or AI wrote text. Humanizer and rewriting features do not guarantee detection outcomes.

You must independently review and verify output before using or publishing it. The Service does not provide legal, medical, financial, tax, academic-integrity, employment, or other professional advice. Do not rely on it for emergency, safety-critical, high-risk, or rights-affecting decisions. You remain responsible for your decisions, submissions, disclosures, and use of output.

7. Paid Lifetime access, pricing, and refunds

A Lifetime purchase provides the features identified in the applicable offer for the commercial lifetime of the Service. "Lifetime" refers to the commercial lifetime of the Service, not your lifetime and not a guarantee of perpetual operation. It does not transfer ownership or include materially separate future products unless the offer expressly says so.

"Unlimited rewrites" means no ordinary daily or monthly rewrite quota for normal individual use. It remains subject to request-size, concurrency, rate, security, cost, and fair-use controls. We may apply reasonable limits to prevent abuse, account sharing, resale, automation, attacks, extreme cost, or degradation for other users. Limits must not contradict a specific non-waivable promise in the applicable offer.

Prices, currency, included features, and taxes are displayed before purchase. Payment is processed by a third-party payment provider. You authorize the applicable charge and represent that you may use the selected payment method. You are responsible for taxes not collected by us where law requires.

You may request a refund within 14 days after purchase. Longer or additional mandatory cancellation and refund rights remain available, including applicable rights for distance purchases. Approved refunds, chargebacks, reversed payments, and unresolved payment disputes revoke the associated paid access. Contact hello@rewritepal.com from the account email for billing support.

8. Third-party services

The Service depends on third-party AI, infrastructure, authentication, analytics, payment, email, browser, and network services. Their availability, rules, and technical behavior may affect the Service. RewritePal may replace a provider without notice when reasonably needed for security, reliability, cost, compliance, or product operation.

Your direct use of a third-party site, account, payment method, browser store, or integration may be governed by that third party's terms. RewritePal is not responsible for third-party products or conduct outside its reasonable control. This section does not limit responsibility that cannot be excluded by law.

9. RewritePal intellectual property

RewritePal and its licensors own the Service, software, interfaces, designs, text, graphics, trademarks, prompts, workflows, routing methods, documentation, and other materials, excluding your Input and rights lawfully assigned to you in output. These materials are protected by intellectual property and unfair competition laws.

If you provide feedback or suggestions, you grant RewritePal a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use them without restriction or compensation. This does not grant us ownership of personal information contained in feedback.

10. Privacy

The Privacy Policy explains how RewritePal handles personal information. By using the Service, you acknowledge that notice. You are responsible for ensuring that your use of the Service, including any submission of another person's information, complies with applicable privacy and confidentiality obligations.

11. Electronic communications

RewritePal may communicate with you electronically when reasonably necessary to provide, administer, secure, or legally operate the Service. These communications may include verification, security, billing, purchase, support, legal, and policy notices.

RewritePal does not currently send promotional newsletters or general marketing campaigns. Promotional communications, if introduced, will be governed by the Privacy Policy and applicable law. You may unsubscribe from promotional communications without affecting essential service-related messages.

12. Suspension and termination

You may stop using the Service at any time and may request account deletion. We may limit, suspend, or terminate access when we reasonably believe you violated these Terms, created legal or security risk, failed to pay, abused the Service, or exposed RewritePal or another person to harm. Where appropriate, we may provide notice and an opportunity to correct the issue, but we are not required to do so for urgent, repeated, fraudulent, illegal, or harmful conduct.

We may discontinue all or part of the Service for legitimate business, legal, security, or technical reasons. If discontinuance materially affects paid access, we will provide any notice, refund, or other remedy required by applicable law and the specific purchase offer. Termination for your breach or a reversed payment does not entitle you to a refund except where law requires one.

Provisions that by their nature should survive termination will survive, including ownership, feedback, payment obligations, disclaimers, liability limits, indemnity, disputes, and general terms.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." RewritePal disclaims express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and quiet enjoyment.

We do not warrant that the Service or output will be uninterrupted, error-free, accurate, complete, unique, lawful, secure, compatible, or suitable for your purpose, or that defects will be corrected. You assume the risks of using, relying on, publishing, or disclosing output. Nothing in this section excludes a warranty or responsibility that applicable law does not allow us to exclude.

14. Limitation of liability

To the fullest extent permitted by law, RewritePal and its affiliates, owners, officers, employees, contractors, licensors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, opportunity, goodwill, use, or data, arising from or related to the Service, even if advised that such damage was possible.

To the fullest extent permitted by law, the total liability of RewritePal and those parties for all claims arising from or related to the Service will not exceed the greater of: (a) the amount you paid RewritePal for the Service during the 12 months before the event giving rise to the claim; or (b) US$100.

These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not apply to fraud, willful misconduct, death or personal injury caused by negligence, or other liability that cannot be excluded or limited under applicable law. Mandatory consumer remedies remain available.

15. Indemnity

If you use the Service for business or professional purposes, or to the extent otherwise permitted by law, you will defend, indemnify, and hold harmless RewritePal and its affiliates, owners, officers, employees, contractors, licensors, and providers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your Input, your use of output, your violation of these Terms or law, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from RewritePal's own unlawful conduct or where consumer law prohibits the obligation.

16. Governing law and disputes

Before filing a claim, you and RewritePal agree to make a reasonable good-faith effort to resolve the dispute informally. Send a description of the dispute and requested resolution to hello@rewritepal.com. This informal process does not extend a limitation period unless applicable law says otherwise.

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules. Courts with jurisdiction under applicable law may hear disputes. If you are a consumer, this section does not deprive you of mandatory protections or the right to bring a claim in a forum available under applicable consumer law, including the courts of your domicile where that right applies.

Where permitted by law, each party may bring claims only in its individual capacity and not as a plaintiff or class member in a representative proceeding. This sentence does not apply where collective, public, or representative rights cannot legally be waived.

Nothing prevents either party from seeking urgent injunctive or equitable relief from a court with jurisdiction to protect intellectual property, confidential information, security, or safety.

17. Changes to these Terms

We may update these Terms prospectively to reflect changes to the Service, our business, or law. We will post the updated Terms and revise the date above. If a change materially affects your rights or paid access, we will provide reasonable advance notice through the Service, by email, or another appropriate method. Continued use after the effective date constitutes acceptance where permitted by law. We will request fresh acceptance when required.

18. General terms

  • Entire agreement. These Terms, the Privacy Policy, the applicable purchase offer, and any terms expressly incorporated by reference form the entire agreement about the Service and replace earlier agreements on the same subject.
  • Order of precedence. Mandatory law controls. Then a specific written purchase offer controls for its subject, followed by these Terms and the Privacy Policy.
  • Assignment. You may not assign these Terms without our written consent. We may assign them as part of a merger, reorganization, financing, sale of business or assets, or transfer to an affiliate, subject to applicable law.
  • Severability. If a provision is unenforceable, it will be enforced to the maximum lawful extent or modified as little as necessary, and the remaining provisions will continue.
  • No waiver. A failure or delay in enforcing a provision is not a waiver. A waiver must be in writing and applies only to the stated instance.
  • Force majeure. RewritePal is not responsible for delay or failure caused by events beyond its reasonable control, including provider outages, network failures, natural disasters, labor disputes, war, civil disorder, government action, and widespread security incidents.
  • Export and sanctions. You may not use the Service in violation of applicable export controls, trade sanctions, or restrictions and represent that you are not prohibited from receiving it.
  • No third-party beneficiaries. These Terms do not create rights for anyone other than you and RewritePal, except indemnified parties may enforce Section 15.
