Acceptance of Terms

By accessing or using RewritePal ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of the Terms, you should not use RewritePal. Using the Service on behalf of an organization indicates that you have the authority to bind that organization to these Terms.

Changes to Terms

RewritePal may modify or update these Terms from time to time. We will notify users of any material changes by posting the updated Terms on our website or through other appropriate means. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service. We encourage you to review the Terms periodically to stay informed of any updates.

Description of the Service

RewritePal is a globally available, AI-powered text rewriting and paraphrasing tool that helps you improve and rephrase your writing. It is currently provided as a free service – there are no fees or subscriptions required to use its features. However, we reserve the right to introduce paid features, subscription plans, or other fees in the future at our sole discretion. We will inform you of any such changes in advance, and any new fees will not retroactively affect content you have already created.

RewritePal strives to enhance your writing, but please note that it is an automated AI service and its outputs may not always be perfect or appropriate (see Disclaimers below).

Permitted Use and Content Restrictions

You may use RewritePal for lawful purposes only. By using the Service, you agree to the following usage rules and content restrictions:

• No Illegal or Harmful Use: You will not use the Service for any illegal, unlawful, or harmful activities. This includes not using RewritePal to generate content that furthers illegal acts, fraud, or any kind of misconduct. Do not use the Service to violate any applicable laws or regulations.
• No Hateful or Harassing Content: You must not use RewritePal to create or disseminate content that is hateful, harassing, abusive, or discriminatory toward any individual or group. This prohibition includes content that constitutes hate speech, threats, bullying, or incitement of violence. RewritePal is committed to maintaining a respectful and safe service for all users.
• No Violent or Exploitative Content: You may not use the Service to produce extremely violent content, sexually explicit material, or content that exploits or endangers minors or any vulnerable individuals. Content related to child sexual abuse or any form of exploitation is strictly forbidden.
• No Intellectual Property Infringement: You agree not to submit or output content that violates the intellectual property rights or privacy rights of others. This means you will not use RewritePal to paraphrase or distribute material that you do not have the right to use (e.g. copyrighted text you do not own) or that includes someone's personal data without consent. You are responsible for ensuring you have the necessary rights to any text you input into the Service.
• No Spam or Malicious Use: You will not use the Service to generate spam, unwanted promotional content, or any malicious code. You must not attempt to interfere with the Service's operation or attempt to bypass any security or content filters. For example, you should not transmit viruses, malware, or engage in activities that could disrupt the Service's functionality.
• Respect for Service Limits: You will use RewritePal in a manner that does not unduly burden our infrastructure. We may impose limits on usage (such as rate limits or text length limits) to ensure stable service for all users. Do not attempt to circumvent these limits or use automated tools to access or use the Service in a way not permitted.

If you violate any of these rules, we may take action including warning you, removing or blocking offending content, or terminating your access to the Service (see Termination below). We reserve the right to monitor usage and investigate any suspected breach of these Terms.

Intellectual Property Rights

Our Content

All rights, title, and interest in and to the RewritePal Service (including our website, software, algorithms, design, and branding) are owned by RewritePal, Inc. or its licensors and are protected by intellectual property laws. This includes the "RewritePal" name, logo, and all content and features provided through the Service, excluding your own submitted text. You may not copy, distribute, modify, reverse engineer, or create derivative works from our Service or its content, except as explicitly allowed by us. Using RewritePal does not grant you ownership of any intellectual property rights in our Service or content.

Your Content

You retain ownership of any text or content that you submit to RewritePal, as well as the rewritten output that the Service generates for you. RewritePal does not claim any ownership over the text you provide or the resulting rewritten text. By using the Service and submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, and process your content only for the purpose of operating the Service and providing the AI-generated rewriting to you. This license allows us to temporarily handle your text (and its AI-generated result) to deliver the functionality of RewritePal. We do not store your text or outputs after processing beyond the immediate needs of providing the service, and we do not use your content for any other purpose (as noted in our Privacy practices).

By submitting any content, you represent and warrant that you have all necessary rights to that content and that its use in the Service (and the generation of rewritten text from it) does not infringe or violate the rights of any third party. You agree that you will not upload or submit any content to which you do not have the rights or any content that violates someone else's intellectual property or privacy.

Output Use

The outputs generated by RewritePal may be used by you for personal or commercial purposes at your own discretion, provided such use is lawful and in compliance with these Terms. RewritePal does not impose additional restrictions on how you use the rewritten text we provide, aside from ensuring that your use does not violate any laws or the rights of others. You are solely responsible for how you utilize the rewritten content.

Disclaimers and Limitation of Liability

AI Generated Content Warning

RewritePal is powered by artificial intelligence. While we strive for high-quality and accurate rephrasing, the Service's output is generated by algorithms and may not always be correct, complete, or suitable for your specific needs. We do not guarantee the factual accuracy, reliability, or appropriateness of any content generated by the Service. The AI may produce errors, inaccuracies, or content that could be interpreted as incorrect or misleading, and it may occasionally produce unexpected or unintended results. You are responsible for reviewing and verifying the accuracy and suitability of the rewritten text before using it, especially in any important or sensitive context. Any reliance on the output is at your own risk, and you should fact-check and use your judgment when using content from RewritePal.

No Warranty

RewritePal is provided to you on an "as is" and "as available" basis, without any warranties of any kind, express or implied. We make no warranty or representation that the Service will meet your requirements, achieve any intended results, be available at all times, be secure or error-free, or that any defects will be corrected. In particular, we do not warrant the accuracy, quality, or reliability of the outputs that the AI provides, and we do not guarantee uninterrupted uptime or availability of the Service.

To the fullest extent permitted by law, we disclaim all warranties and conditions of any kind, whether express, implied or statutory, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Use at Your Own Risk

You agree that your use of RewritePal is at your sole risk. You understand that by using an AI tool, you might receive content that is unexpected or imperfect. We are not responsible for any decisions you make or actions you take based on the content generated by RewritePal, or for any harm or losses that may result from such decisions or actions. You assume full responsibility for any use of the Service and any consequences that arise from the content you obtain through it.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall RewritePal or its parent company, affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential or exemplary damages arising out of or in connection with your use of (or inability to use) the Service. This includes, but is not limited to, any loss of profits, loss of data, business interruption, damage to reputation, or other intangible losses, even if we have been advised of the possibility of such damages.

RewritePal's total cumulative liability for any claims arising out of or related to the Service is limited to the amount (if any) you paid us for the use of the Service in the past six months (or an equivalent amount of USD if no payment was made, since the service is free).

Some jurisdictions do not allow the exclusion or limitation of certain liabilities, so some of these limitations may not apply to you. In such cases, our liability will be limited to the fullest extent allowed by applicable law.

No Professional Advice

The content generated by RewritePal is for general rewriting purposes only. It is not professional advice. Because the AI may produce incorrect or nonsensical output at times, you should not rely on it for critical decisions or as a substitute for professional advice (such as legal, medical, financial, or other expert advice). Always seek the advice of qualified professionals if you need guidance in those areas. RewritePal makes no claims or warranties that AI-generated content will be suitable for professional or specialized use.

Service Reliability

While we aim to keep the Service up and running, we do not guarantee that RewritePal will be available at any given time or that it will be free from errors, delays, or interruptions. Outages, maintenance, or technical issues may occur from time to time. We are not liable for any inability to access the Service or loss of content you might experience due to downtime or technical problems. We appreciate your understanding and will do our best to restore service as quickly as possible when disruptions occur.

Termination

You may stop using RewritePal at any time. Similarly, we reserve the right to suspend or terminate your access to the Service at our discretion, at any time and for any reason. This includes (but is not limited to) situations where we believe you have violated these Terms, used the Service in a way that is harmful to others or to RewritePal, or if we decide to discontinue the Service. We may terminate or suspend the Service with or without prior notice to you.

If your access is terminated due to a violation of these Terms or illegal conduct, you may be banned from re-registering or using the Service in the future. In the event of termination, the disclaimers, limitation of liability, and other provisions in these Terms that by their nature should survive termination will continue to apply. For example, your obligations regarding any content you've already obtained, and our disclaimers of warranties, will remain in effect even after your access to the Service is ended.

Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. We make no representations that the Service is appropriate or available for use in all locations, and accessing the Service from jurisdictions where its content or operation is illegal is prohibited.

If you reside in a jurisdiction with consumer protection or other laws that require different terms or rights than as provided in these Terms, those laws will apply to you only to the extent they are applicable and cannot be waived by contract.

Any disputes arising out of or relating to these Terms or your use of RewritePal shall be addressed in a friendly and prompt manner. In the event we cannot resolve a dispute informally, any claim or controversy shall be resolved in the courts of the United States (unless another mode of dispute resolution is required by applicable law, or agreed upon in writing, such as arbitration).

You and RewritePal agree to submit to the personal and exclusive jurisdiction of the courts located in the United States for the purpose of litigating any such disputes, unless otherwise required by law. Notwithstanding the foregoing, RewritePal may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Class Action Waiver: Where permitted by law, you agree that you may bring claims against RewritePal only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

International Use: If you are accessing the Service from outside the United States, be advised that you are responsible for complying with local laws in your jurisdiction. These Terms apply regardless of your location, but certain additional rights or laws may apply to you as noted above.
